Nebraska Online Sports Betting Measures Certified for November Ballot

Two citizen-led initiatives to legalize and regulate online sports betting will appear before Nebraska voters in the November 3, 2026 general election, after the Secretary of State’s office certified both petitions in August. The measures – the Online Sports Wagering Authorization Constitutional Amendment and the Online Sports Wagering Regulation Initiative – each exceeded the required number of valid signatures, setting the stage for a consequential vote in a state where mobile wagering remains prohibited.

Background: From Retail to Mobile

Nebraska voters approved three ballot initiatives in 2020 that legalized casino gambling at licensed racetracks, and sports betting is currently permitted in person at those venues. However, online sports wagering has remained outside the state’s regulatory framework, leaving residents in bordering proximity to legal mobile markets elsewhere.

The current petition drive began in early 2026, when the final language for the two measures was approved and circulation commenced. Backed significantly by gambling industry funding – including contributions from major online sports betting platforms and casino interests – the campaign, organized in part through the ballot question committee Tax Relief Nebraska, submitted signatures in July.

Signature Thresholds and Certification

To qualify, a statutory initiative in Nebraska requires valid signatures from at least 7 percent of registered voters, while a constitutional amendment requires 10 percent. The Online Sports Wagering Authorization Constitutional Amendment petition collected at least 138,473 valid signatures, according to a press release from the Secretary of State’s office, surpassing the constitutional threshold.

The constitutional amendment would permit the Legislature to enact laws authorizing and governing sports wagering conducted online. The companion statutory measure establishes the regulatory framework for such wagering. Because both measures cleared review, they will appear on the November 3 ballot.

Ongoing Scrutiny

The certification process has not been without controversy. An investigation into potentially fraudulent petition signatures expanded in August to cover all four statewide citizen-led initiatives on the 2026 ballot, including the two sports wagering measures. State officials have continued reviewing the validity of signatures collected during the campaign, and outcomes of that review could influence the measures’ standing.

Campaign representatives have indicated that, should the initiatives qualify, subsequent steps would include a broader public campaign ahead of the general election.

What the Measures Would Do
